Terms and Conditions

These Terms and Conditions govern your access to the Healthy Flavoors website, your account, meal orders, and weekly meal-plan services. By using the website, creating an account, or placing an order, you agree to these terms and our Privacy Policy. If you do not agree, do not use the services or place an order.

1.About Healthy Flavoors

“Healthy Flavoors,” “we,” “us,” and “our” refer to the operator of the Healthy Flavoors meal-preparation and delivery service. “You” means the customer or website user. “Meals” and “products” mean the food and related items offered through our website. “Services” include our website, customer account, ordering, subscription, payment, and delivery services.

2.Service availability and eligibility

Our delivery service is available only in the delivery areas shown as eligible by our postal-code checker, currently within selected Greater Toronto Area locations. Availability may change because of routing capacity, weather, public holidays, or operational limits.

You must be at least 18 years old, legally able to enter a contract, and provide a valid delivery address within our service area. We may decline or cancel an order when an address is outside our service area or when we cannot safely complete delivery.

3.Accounts, orders, and weekly subscriptions

You must provide complete and accurate account, contact, delivery, and payment information. You are responsible for keeping this information current and for protecting your password and account access.

An order is accepted when we provide an order confirmation. We may reject or cancel an order because of unavailable meals, payment failure, suspected fraud, incorrect pricing, delivery limitations, or other reasonable operational concerns. If we cancel a paid order, we will provide any refund required by applicable law.

Meal plans renew weekly until paused or cancelled. By starting a weekly plan, you authorize Healthy Flavoors and its payment processor to charge the payment method saved to your account for your initial order and future weekly orders, including applicable taxes and disclosed fees.

Your meal selection may repeat each week. Menu items are subject to availability. If an item becomes unavailable, we may contact you, offer a reasonable substitution, provide account credit, or refund the affected item as appropriate.

4.Meal changes, plan changes, pauses, and cutoff

The change deadline is 12:00 AM America/Toronto time, four calendar days before the scheduled delivery date. Before that deadline, you may change your selected meals or plan through your account, subject to available plan sizes and menu inventory.

At and after the deadline, the upcoming selection is locked and cannot be changed. A change made after the deadline applies only when the website expressly confirms that it will apply to a later delivery.

You may pause, reactivate, or cancel your weekly plan through your account. A pause or cancellation submitted after an applicable cutoff may not affect an order already processed for the upcoming delivery. No cancellation fee is charged, but amounts already committed to a processed order may be non-refundable except where required by law.

5.Delivery, access, and risk

We deliver to the address saved with your order. You are responsible for providing accurate access instructions and ensuring that the location is safe and accessible. Delivery windows are estimates and may change because of traffic, weather, building access, or events beyond our reasonable control.

If no one is available, you authorize us to leave the delivery in a reasonably safe location at or near the address when permitted. Risk of loss passes to you when the delivery is completed at the designated address. We are not responsible for spoilage, theft, or damage occurring after delivery when caused by delayed collection, incorrect instructions, an unsafe drop-off location, or failure to refrigerate the meals promptly.

Inspect deliveries promptly and contact us as soon as reasonably possible if an order is missing, damaged, unsafe, or incorrect.

6.Food safety, allergens, and health disclaimer

Refrigerate meals promptly after delivery and follow the storage, use-by, and reheating instructions supplied with each meal. Do not consume food that appears spoiled, damaged, improperly sealed, or unsafe.

Our kitchen may handle common allergens, including milk, eggs, wheat, soy, sesame, peanuts, tree nuts, fish, shellfish, and mustard. Cross-contact may occur. Menu names, filters, photographs, and descriptions are not a guarantee that a meal is free from an allergen. Contact us before ordering if you have an allergy or dietary restriction.

Nutrition values displayed on the website may be estimates and can vary with ingredient sourcing, preparation, and portioning. Healthy Flavoors does not provide medical advice. Consult a qualified health professional regarding allergies, medical conditions, dietary changes, or nutrition needs.

7.Prices, taxes, and payment

Prices, plan sizes, taxes, delivery fees, discounts, and the total charge are shown during checkout. Prices are in Canadian dollars unless stated otherwise. We may change future prices or plan offerings with notice required by applicable law; changes do not alter an already confirmed order unless you agree or the law permits.

Payments are processed securely by Stripe. We do not store complete card details on our servers. You confirm that you are authorized to use the payment method provided and authorize charges associated with confirmed orders and your weekly subscription.

If payment fails, we may retry the saved payment method, ask you to update it, pause fulfilment, suspend the account, or cancel the affected order. You remain responsible for valid charges already incurred.

8.Cancellations, order issues, credits, and refunds

Refunds and credits are assessed based on the circumstances, food-safety considerations, the portion of the order affected, and applicable consumer-protection law. Because meals are perishable, returns may not be accepted unless requested by us.

When reporting a problem, provide the order number, a description, and photographs when reasonably requested. Approved refunds are ordinarily returned to the original payment method; processing time depends on the payment provider. Promotional credits have no cash value unless applicable law requires otherwise.

Nothing in these terms limits a non-waivable right or remedy available under applicable consumer-protection law.

9.Promotions, acceptable use, and intellectual property

Promotional codes are subject to any additional terms displayed with the offer. Unless stated otherwise, codes are limited to one use per customer, cannot be combined, are not redeemable for cash, and may be withdrawn when obtained or used through fraud, error, or abuse.

You may not misuse the website, interfere with its operation, access another person’s account, introduce malicious code, scrape content without permission, make fraudulent purchases, or use our content for unauthorized commercial purposes.

The Healthy Flavoors name, website design, photographs, text, graphics, software, and other content are owned by or licensed to us and are protected by intellectual-property laws. Personal, non-commercial use of the website does not transfer any ownership rights.

10.Disclaimers and limitation of liability

We aim to keep the website and services accurate and available, but they may occasionally be interrupted or contain errors. To the fullest extent permitted by law, services are provided without guarantees beyond those expressly stated in these terms and those that cannot legally be excluded.

To the fullest extent permitted by law, Healthy Flavoors is not liable for indirect, incidental, special, punitive, or consequential losses, or loss of profits, data, goodwill, or opportunity arising from the website, products, or services. Our aggregate liability relating to an affected order will not exceed the amount you paid for that order, except where such a limit is prohibited by law.

Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, wilful misconduct, or personal injury caused by negligence where applicable.

11.Suspension, force majeure, changes, and governing law

We may suspend or terminate an account for material breach, fraud, abusive conduct, payment failure, security risk, or unlawful activity. We may discontinue the service or modify these terms by providing notice required by law. Continued use after an effective change constitutes acceptance where permitted by law.

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disaster, epidemic, labour disruption, government action, transportation interruption, utility failure, supplier disruption, or telecommunications failure.

If any provision is invalid or unenforceable, it will be modified only as much as needed, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your agreement without our consent; we may assign it as part of a business transfer or reorganization, subject to applicable law.

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Courts located in Ontario have jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere. Québec consumers retain all mandatory rights under Québec law.
